Welcome to FunkyMap. These Terms of Service govern your access to and use of funkymap.com and all associated features and services, referred to as the Service, legally operated from Austria. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Description of the Service
FunkyMap is an interactive, crowdsourced global sound map. The Service allows any visitor to browse a world map and listen to audio content associated with geographic locations, referred to as audio signals. Authenticated users may additionally upload their own audio signals, vote on content submitted by others, and maintain a public profile. The Service also includes informational and editorial content, including a Blog, a Tutorial, and Frequently Asked Questions.
Eligibility
The Service is intended for users who are at least sixteen years of age, in line with the minimum age of consent for data processing under the General Data Protection Regulation as implemented in Austria. By creating an account, you confirm that you meet this requirement.
Accounts and Authentication
FunkyMap does not use local passwords. Accounts are created and accessed exclusively through third-party sign-in, currently via Google or Twitch. You are responsible for maintaining the security of the account used to sign in, and for any activity that occurs under your FunkyMap account as a result. We reserve the right to suspend or permanently terminate any account that violates these Terms, our Community Guidelines, or applicable law.
Our Role as a Hosting Provider
In accordance with the Austrian E-Commerce Act and the EU Digital Services Act, FunkyMap acts solely as a hosting provider and intermediary with respect to content submitted by users. We do not actively review all content prior to publication. We act promptly to remove or restrict access to content that violates these Terms once we become aware of it.
Content You Upload
By uploading audio, images, descriptions, or any other content to FunkyMap, you confirm that you own the content or hold all necessary rights and permissions to upload and share it, and that it does not infringe the rights of any third party. You grant FunkyMap a non-exclusive, worldwide, royalty-free license to host, display, and stream your content on the Service for as long as it remains on the platform. You retain ownership of everything you upload, and you may remove it from the Service at any time.
Content That Is Not Permitted
You may not upload or share content that is unlawful, infringes copyright or other intellectual property rights, contains hate speech, harassment, or threats, sexualizes or otherwise endangers minors, is deliberately false or misleading, or attempts to manipulate the platform's voting system through fraudulent means. A complete list of prohibited content is available in our Community Guidelines. Violations may result in content removal, account suspension, or permanent termination at our discretion.
Reporting Copyright Infringement
If you believe content on FunkyMap infringes your copyright, please contact us through our Contact page with a description of the copyrighted work, the specific location of the content on FunkyMap, your contact information, and a statement that you have a good-faith belief the use is unauthorized. We investigate valid notices and remove infringing content where warranted.
Ownership of the Platform
Aside from content submitted by users, all elements of the Service, including its design, software, branding, and original written content, are the property of FunkyMap or its licensors. You may not copy, modify, or create derivative works based on the Service without prior written permission.
Disclaimers and Limitation of Liability
The Service is provided on an as-is and as-available basis, without warranties of any kind. FunkyMap does not guarantee that the Service will be uninterrupted, error-free, or free of content submitted by other users that some may find objectionable. To the fullest extent permitted by law, FunkyMap is not liable for indirect or consequential damages arising from your use of the Service, except where liability cannot be excluded under Austrian or EU consumer protection law.
Ending Your Use of the Service
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to all or part of the Service at our discretion, including for violations of these Terms, without prior notice where circumstances require immediate action.
Changes to These Terms
We may revise these Terms from time to time to reflect changes to the Service or applicable law. Material changes will be indicated by an updated date at the top of this page. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of Austria, based on the location where FunkyMap is legally operated. Any disputes arising from these Terms or your use of the Service are subject to the exclusive jurisdiction of the competent courts of Austria, without prejudice to any mandatory consumer protection rights you may hold in your country of residence.
